These Terms and Conditions govern your use of the Nummeric application ("the App") developed and published by Neogy LLC ("we," "us," "our"). By downloading, installing, or using Nummeric, you agree to these terms.
1. License
Neogy LLC grants you a limited, non-exclusive, non-transferable, revocable license to use Nummeric for personal or commercial calculation purposes on Apple devices you own or control, subject to the Apple Media Services Terms and Conditions.
2. Permitted Use
You may use Nummeric for any lawful purpose including personal, educational, and professional calculations. You may not:
- Reverse-engineer, decompile, or disassemble the App
- Redistribute, sublicense, or resell the App
- Use the App to develop a competing product
- Remove or alter any proprietary notices in the App
3. Accuracy Disclaimer
Nummeric is designed to provide accurate mathematical calculations. However, no calculator software is infallible. Nummeric is not a substitute for professional financial, medical, engineering, or legal advice. Results should be independently verified for critical applications. Neogy LLC is not liable for decisions made based on calculations performed with the App.
4. Intellectual Property
Nummeric, including its design, code, graphics, themes, and documentation, is the intellectual property of Neogy LLC. All rights not expressly granted in these terms are reserved.
5. Payment
Nummeric is distributed through the Apple App Store. All purchases are processed by Apple and subject to Apple's payment terms. Nummeric is a one-time purchase with no recurring fees. Refund requests must be directed to Apple per their refund policy.
6. Updates
We may release updates to Nummeric that add features, fix bugs, or improve performance. Updates are delivered through the App Store and are free for the lifetime of the product. We are not obligated to provide updates on any particular schedule.
7. iCloud Sync
If you enable iCloud sync, your data is transmitted and stored using Apple's CloudKit infrastructure. This is subject to Apple's iCloud Terms of Service. Neogy LLC is not responsible for iCloud service availability or data loss resulting from iCloud issues.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Neogy LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App. Our total liability for any claim arising from these terms shall not exceed the amount you paid for the App.
9. Warranty Disclaimer
Nummeric is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Termination
These terms are effective until terminated. Your rights under these terms will terminate automatically if you fail to comply with any of them. Upon termination, you must cease all use of the App and delete all copies.
11. Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of New Hampshire, United States, without regard to conflict of law principles.
12. Changes to These Terms
We may update these terms from time to time. The updated version will be indicated by an updated date at the top of this page. Your continued use of the App after changes are posted constitutes acceptance of the revised terms.
